Under the Comprehensive Environmental Response, Competition and Liability Act of 1980, otherwise known as the Superfund, liability for hazardous waste and contamination of properties can be transferred to unwitting buyers if a proper site assessment is not completed beforehand. The cost of cleaning up a site can be incredibly expensive and cause serious delays in development, and potentially make development uneconomical all together. Site assessments that adhere to Superfund legislative requirements can ensure the purchaser is qualified for exemption from liability as an innocent landowner, contiguous landowner or bona fide prospective purchaser.
